It also recommends that a the DSI clinic establishes a guidance and counseling unit that will help employees going through stressful times. DSI is a conglomeration of clinics that provide dialysis around the United States for people suffering from chronic kidney failure. DSI provides quality care for patients in areas like nephrology and other specialized aspects of dialysis. It is made up of highly qualified nephrologists, nurses, doctors, administrators and support staff members who work hard to maintain the image of DSI as a leading dialysis center in the United States. However, due to the current financial crises, the management of the clinic have had the unpleasant duty of laying off a number of workers. This has led to many workers doing extra hours and others expanding the scope of their work. This has led to a strain on the staff of the company. There have been numerous cases of mistakes, low productivity and a high turnover because of the new arrangements. This has clearly created a situation of low morale amongst staff and workers of DSI. There is clear evidence that the low morale is caused by stress and the increased workload of the company staff. This has led to poor performance. The group that is mostly affected by this spate of stress is the female employees who constitute 88% of the total employees in the clinic. The purpose of this research is to use scientific tools to empirically study the relationship between job stress and low morale and low productivity at DSI Clinic. It will identify the possible solutions to the problem and recommend actions that must be taken to reduce the effects of low morale at DSI clinic. Different Approaches To Completing Tasks

Different Approaches To Completing Tasks Imagine that you work for a multinational IT company and have been transferred to Japan for five years project. You want to adjust yourself culturally to the new environment so that you do not have cross cultural problems. Which aspect of the local culture would you wish to observe and understand in order to avoid problems of cross cultural communication? INTRODUCTION Communication is the process of exchanging ideas, facts and figures from one person to another. The term cross cultural implies interaction with people of different cultural, ethnic, age and class backgrounds. Communication is interactive in nature and is greatly influenced by our relationship with others. Different words may mean different meanings to different people. In addition to this what makes cross cultural communication really difficult is the difference in language even the same word can mean different things. Cross cultural communication is a form of global communication which describes how people of different culture communicate and interact with each other in different ways among themselves. Cross cultural communication is a field of study that draws various ways that we have learned to speak and gives non-verbal messages. Thus miscommunication is likely to happen when it involves significant cultural differences among the communicators. This is what known as Cross Cultural difference. FUNDAMENTAL PATTERNS OF CULTURAL DIFFERENCES There are six different cultural patterns that tend to vary from one person to another person. These are discussed as follows: Varying communication styles The way people communicate varies widely within people of different cultures. What may mean to one person may have a different meaning to other person. This aspect of communication style is known as language usage. Some words carries different meaning across different cultures. Another aspect of the communication style is the degree of importance given to verbal and non-verbal communication. Non-verbal communication not only includes gestures and facial expressions but also involves sense of time, personal distance etc. Different approaches to completing the tasks Approaches to completing tasks vary from culture to culture. The reason behind this is different judgments of the rewards associated with the accomplishment of the task, different notions of time and access to resources available. For example Asian culture tends to give more importance to the developing relationships and emphasize more on the task completion towards the end as compared to the European-American culture. Varying attitudes towards conflicts Some cultures see conflict in positive manner while others view it as something to be avoided. In the U.S conflict is not considered to be desirable however people often are encouraged to directly face conflicts as they arise. In eastern countries conflicts are considered to be embarrassing; a written exchange might be favorable means to address the conflict instead of speaking. Different styles of decision making The role played by an individual in decision making process varies from culture to culture. For example in US decisions are frequently delegated i.e. an official assigns the responsibilities to the subordinates associated with the task while in Japan consensus is the preferred mode. Different attitudes towards disclosure In some cultures it is not considered appropriate to be open about emotions, personal feelings and information or a conflict or misunderstanding. When you are working with others or dealing with a conflict questions like what was the conflict about? Or what was your role in the conflict may seem natural to you but may seem intrusive to others. Varying approaches to knowing Differences are likely to occur among cultural groups when it comes to knowing things. For example European culture tends to consider information acquired by measuring and counting rather than the other ways of coming to knowing things. Compare that to African cultures preference for affecting ways of knowing things including rhythm and symbolic imagery. Some of the common aspects and challenges that he observed in Japanese culture are discussed as follows: Rules and etiquettes Japanese adheres closely to rules and regulations. It was clearly evident from the low crime rates. Aspects of etiquettes include vocabulary, grammar for polite conversation, Principles for exchanging gifts and greeting others. This made him aware that Japanese are very certain about their rules and regulations. Hierarchy In Japan a strong hierarchical structure still exists with respect, responsibility and authority being rewarded based on age, status and experience. When communicating with Japanese it is considered wise to pay attention towards the face. Face is closely linked with personal pride and forms the basis for an individuals status and reputation. Damaging face through over confrontation can be disastrous for business relationship in Japan. Concept of time Time is one of the major challenges while working in Japanese culture as Japanese are very strict regarding the punctuality. While working being early or on time for all appointments, meetings whether formal or informal is a show of respect and sincerity towards the task while any event of being late requires an apology. Communication styles Understanding communication style is another biggest challenge that is often faced while working in Japanese culture. Japanese have a preference for indirect and high context communication. They emphasize more on the impact of body language, developing relationship, emotions and other non-verbal communication. Harmony In Japan there is more emphasizing on collectivism rather than individualism. They place significant emphasize on loyalty towards the group. In Japanese culture it is important to understand that praising or prioritizing any one individual over others is likely to be embarrassing. Excessive hard working attitude Japanese people are highly dedicated to their work. For them, there is no day-night, hunger-thirst. When they are determined to achieve something, they achieve it any cost without thinking about any kind of comfort. For example if in India, 10 cars are manufactured in a day then in Japan, that number is 100. So, this is also a major challenge. OVERCOMING CROSS CULTURAL DIFFERENCES No matter whom you are or where you live or which culture you come from it is important to recognize that although other people may dress like you or even work for the same company they are not just like you. Some of the common aspects that Mr. A observed and decided to follows in order to overcome cross cultural differences are discussed as follows. The key to effective cross cultural communication is knowledge. It is very essential for people to understand the potential problems of cross cultural communication and to be prepared to adjust your behavior accordingly. Try to learn from generalizations about other cultures, but do not use those generalizations to oversimplify your ideas about other persons. One should practice and practice because the more effort you put in observing and learning about other culture more easily you can overcome cross cultural difference. One should not assume that his way of communicating is the only right way of communication in fact one should keep questioning about his assumptions about the right way to communicate. Try to listen actively and empathetically. By putting yourself in the other persons shoes especially when other persons perceptions and ideas are completely different from your own, you might need to operate at the edge of your own comfort zone. Another key ingredient that helps in overcoming cross cultural difference is developing awareness about an individuals culture. This is because if you dont have understanding about different cultures than how do you communicate to someone who understands and relates to the world differently to you. Reflective listening plays an important role in overcoming cross cultural differences. It is very helpful in checking out the meaning of what someone says by repeating back what you have heard which in turn helps you to confirm what has been said accurately. Another important point that one must keep in his mind at workplace is to be wise. People need to be aware how to interact with people with respect and knowledge. One must show maturity of thought and action in dealing with people. Thus working across different cultures requires a diverse skill set and a different business approach from business in general. When bridging the cultures both similar and foreign to our own certain strategies are crucial for the success of international project which are briefly described as follows. Learning about the project beforehand This helps to get a feel for the atmosphere, attitude and the angle that the business has. Observing new environment One must carefully observe how people act, dress and treat each other. This will keep a persons observation skills engaged and alert to elements that will help you to adjust in new environment easily. Allow more time Working across different culture takes more time to adjust. Communication may be slowed and logistics may be different. Give yourself more time to process information before taking any decision. Learn to tolerate uncertainty Definitive and concrete answers may not always be given especially when you working with Japanese culture with high tolerance for uncertainty.

The Nature of Love Explored in A Midsummer Nights Dream Essay

â€Å"The course of true love never did run smooth,† comments Lysander of love’s complications in an exchange with Hermia (Shakespeare I.i.136). Although the play A Midsummer Night’s Dream certainly deals with the difficulty of romance, it is not considered a true love story like Romeo and Juliet. Shakespeare, as he unfolds the story, intentionally distances the audience from the emotions of the characters so he can caricature the anguish and burdens endured by the lovers. Through his masterful use of figurative language, Shakespeare examines the theme of the capricious and irrational nature of love. As the play opens, Theseus, Duke of Athens, and Hippolyta, his fiancà ©e discuss their upcoming wedding. With the introduction of Theseus and Hippolyta, Shakespeare presents the backdrop for the multi-faceted love relationships which take place in the play. In an effort to celebrate the occasion with â€Å"pomp, triumph and reveling†, (Shakespeare I.i.20) Theseus instructs Philostrate, Master of the Revels, to â€Å"stir up the Athenian youth to merriments† (Shakespeare I.i.13) as well as to provide entertaining distractions for him and Hippolyta until their wedding. These simple, innocent instructions for merriment and entertainment set the stage for Shakespeare to intricately weave the young lovers, the fairies and the rustics into the story. Introducing the main conflict, Egeus, an Athenian citizen seeking the wise counsel of Theseus, arrives. Egeus’ complaint is against his daughter, who refuses to wed Demetrius, the suitor he has chosen. Although Demetrius loves Hermia, she has given her heart to Lysander and therefore refuses to obey her father and Athenian law. Interestingly, Demetrius not too long ago professed his love for Helena,... ...ss of love. The audience must wonder if Demetrius will have another change of heart or if he has truly matured. Thomas Marc Parrott asserts of Shakespeare’s A Midsummer Night’s Dream, â€Å"It is his use of language, as in so much else in this play, that Shakespeare shows himself the master† (Kehler 22). Through Shakespeare’s intricate weaving of figurative language throughout the play, he leads the audience on an imaginative, melodramatic, and enchanting parody of exploration into the complexities of love. As Parrott contends, Shakespeare’s true expertise lies in his artful handling of the complexities and subtleties of both the written and spoken word. Too Big To Fail

The idea that a business has become so large and ingrained in the economy that the government will provide assistance to prevent its failure. â€Å"Too big to fail† describes the belief that if an enormous company fails, it will have a disastrous ripple effect through shout the economy. The idea of too big to fail should never be possible. No single financial institute should have the power of bringing down our entire economy. The taxpayers should not have to be worried about whether or not their money is safe. There obviously has been a lack of leadership going wrought the economic system. If there were strong leaders put in place originally to deal with this situation, then so many things could have been prevented. A crisis that nearly destroyed our nation would have never even made it to the surface. I blame the lack of leadership for the economical scare. The worlds leaders should have been containing the problem as it started instead of allowing it to get that big and pote ntially blowing up. Fannies Mae and Freddie Mac could have been saved. But instead each bank was focused on their own needs which is understandable and appropriate. But since they were intertwined so heavily was no longer an option. These institutes should have kept their distance to prevent something from happening. Our economical leaders should have practiced better leadership skills and not but all our dollars in one basket. Because just like in 2008, if any piece of that basket were to break or be destroyed we all would go down. The buyout may have worked this time, but that is simple a patch on the service of our overall problem. Get some strong leaders in those seats and all these problem might just go away. Dying Declaration Under Section 32 of Ipc - 15499 Words

DYING DECLARATION â€Å"Truth sits on the lips of a person who is about to die† Introduction A Dying Declaration means the statement of a person who has died explaining the circumstances of his death. It can be said to be a statement made by a mortally injured person, indicating who has injured them and/or the circumstances surrounding their injury. The injured is aware that he/she is about to die and while the declaration is hearsay, it is admissible since it is believed that the dying person does not have any reason to lie. Such a statement can be proved when it is made by a person as to the cause of his death, or as to any of the circumstances of the transaction which resulted in his death. The statement will be relevant in every case or†¦show more content†¦So, they held his statement to be inadmissible under section 32. Circumstances of the transaction which resulted in his death The other important condition for the admissibility of a statement as a dying declaration is that it must relate to the circumstances of the transaction which resulted in his death. This was vividly explained by the Privy Council in the Case of Pakala Narayana Swami v. The Emperor. The facts of the case were that the accused had borrowed Rs. 3000 from the deceased during 1936. On 20th March, 1937, the deceased received a letter from the accused inviting him to come that day or next to Behrampur. The deceased left his house on 21st March, 1037 in time to catch the train for Behrampur. But he did not come back. On 23rd March, 1937, at about noon, his dead body was found in a steel trunk in a third class compartment at Puri. The dead body was identified by the widow. The accused was tried and convicted for murder and sentenced to death. During the trial, the widow of the deceased stated before the Court that on that day her husband showed her a letter and said that he was going to Behr ampur as the appellant’s wife had written to him and told him to go and receive payment for his dues. This statement was objected by the appellant because it was not a statement after theShow MoreRelatedAruna Shanbaug Case - Supreme Court of India14522 Words   |  59 Pagesfeel like a ship in an uncharted sea, seeking some guidance by the light thrown by the legislations and judicial pronouncements of foreign countries, as well as the submissions of learned counsels before us. Presume vs. Assume Choosing the Correct Word

Among their other definitions, presume and assume both mean to suppose. However, the two terms suggest different levels of confidence, so they arent interchangeable. Heres how to use these words correctly. How to Use Presume Presume means to suppose, to take for granted, or to take something on (such as a dare or an attitude). The word stems from a Latin verb meaning to take upon oneself, to take liberty, or to take for granted. When presume is used to mean â€Å"to suppose,† the implication is that the supposition is believed to be true based upon proof of evidence or probability. While it does not imply that the supposition is necessarily correct, it does suggest that the speaker (the person doing the presuming) has based their view on available proof. One interesting usage of presume is the familiar legal phrase â€Å"presumed innocent until proven guilty.† Even though there is no evidence of an individuals innocence, the court system intentionally presumes their innocence at the beginning of a trial. In other words, the trial begins with the confidently-held belief that the defendant is innocent. Consequently, the burden of proof falls on the prosecution to demonstrate the defendants guilt. How to Use Assume Assume means to suppose, to take for granted, or to take something on (such as a role). This definition overlaps significantly with that of presume, but there are some meaningful distinctions. When assume is used to mean to take something on, it refers to taking on a new responsibility, a task, or a role. For instance, you might assume a false identity, or assume the position of club secretary. When assume is used to mean â€Å"to suppose,† the implication is that the speaker does not have reason or evidence to back up their assumption. Examples Peter sent his friend a letter three weeks ago, but still hasnt received a response. He assumed that the letter got lost in the mail. Peter has no evidence to back up his belief that the letter was lost in the mail; thus, he is making an assumption. Sally heard a knock on the door. I presume thats Mr. Jones, she said. I invited him over for dinner this evening. Sally is confident in her statement. She invited Mr. Jones over for dinner, so she has solid evidence that he is the person knocking on her door. Sarah is a vegan, so I presume she wont want any of this cheese pizza. In this sentence, the speaker is using evidence to make an educated guess that Sarah will not want pizza based on previous knowledge of her diet, Abraham Lincoln assumed the position of president on March 4, 1861. Here, assume is used to indicate that the subject of the sentence is taking on a new role. How to Remember the Difference   Struggling to remember when to use each word? Keep in mind that presume and proof start with the same two letters. To presume something is to suppose that it is true based on proof (or the belief that there is proof), whereas assumptions are not based upon any evidence or proof.
